§ 1 General, clientele, contract language(1) Altmuehltal Relocation Carolin Rackl und Reinhard GbR (hereinafter referred to as "Altmuehltal Relocation") enables customers to make use of certain services on the Internet presence at https://www.altmuehltal-relocation.de (hereinafter referred to as "Online Presence"). All offers and services based on orders placed by our customers (hereinafter referred to as "Customers") via the Online Presence are subject to these General Terms and Conditions.
(2) Information about Altmuehltal Relocation is available to our customers here (link to imprint).
(3) The range of services offered by our online presence is aimed equally at consumers and entrepreneurs.
For purposes of these Terms and Conditions,
(a) a
consumer
is any natural person who enters into the contract for a purpose which can be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB) and
(b) an
entrepreneur
is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of his commercial or independent professional activity (Section 14 (1) BGB).
(4) Terms and conditions of the customer who are entrepreneurs within the meaning of (3) (b) shall not apply, even if we do not separately object to their application in individual cases.
(5) The language available for the conclusion of the contract is exclusively German. Translations of these Terms and Conditions into other languages are for your information only. In the event of any differences between the language versions, the German text shall take precedence.
§ 2 Subject matter/conclusion of contract(1) The presentation of our services on our online presence is, unless it expressly states otherwise, subject to change and non-binding, unless the offer is designated in writing as binding.
We organize and accompany the international transfer to the city triangle of Nuremberg, Regensburg, and Ingolstadt for employees of resident companies or private individuals from all over the world. It is often difficult to know the necessary steps for hiring foreign employees without the corresponding experience. Challenges such as the selection and application of the appropriate entry and residence permit, the search for housing or the best possible integration often cause concern.
We support our clients from the beginning to the end or even during individual phases with all these challenges.

Altmuehltal Relocation expressly points out that Altmuehltal Relocation does not guarantee or owe any specific success for the services it provides and does not assume any liability in this regard. Furthermore, no legal advice is given.
(2) The extent of the order and its processing shall be determined exclusively by the service booked by the customer and our order confirmation.
(3) The customer's order constitutes an offer to Altmuehltal Relocation to conclude a contract for the service ordered by the customer. If the customer places an order via the Internet or e-mail, they will receive an e-mail from Altmuehltal Relocation confirming receipt of the order and listing details of the order (order confirmation). This order confirmation does not constitute an acceptance of the customer's offer, but merely informs the customer that their order has been received by the service provider.
(4) A customer's order confirmation shall be deemed to be a binding acceptance of the order contents specified in the confirmation. The customer is bound to an order signed by them and not yet accepted by us for 14 calendar days after sending. We are entitled to accept the offer within this period. The date on which our acceptance is received by the customer shall be decisive for compliance with the deadline.
(5) A contract with the customer shall only be concluded if we accept an order by issuing an order confirmation or by performing the service. The acceptance period of an order for us is 10 (ten) days from its receipt.
(6) The contractual provisions with details of the agreed services, including these General Terms and Conditions and the cancellation policy (insofar as a so-called distance selling contract exists), shall be handed over to the customer directly or sent by e-mail with acceptance of the contractual offer or with notification thereof. A storage of the contract provisions by us does not take place.
(7) Any customer who is a consumer is entitled to revoke the offer in accordance with the special revocation instructions provided to them as part of the order on our website.
§ 3 Contract duration and implementation(1) The duration of the contract as well as the time of the service result from the specific agreements between us and the customer. The contract ends automatically at the time when the last service provided according to this agreement expires.
(2) With regard to termination, the statutory provisions shall apply.
(3) The right to terminate the contract for good cause shall remain unaffected. Good cause shall be deemed to exist if facts are given on the basis of which the terminating party, considering all circumstances of the individual case and weighing the interests of the contracting parties, can no longer reasonably be expected to continue the contract.
(4) The notice of termination must be in text form.
§ 4 Obstruction/Higher force(1) If Altmuehltal Relocation sees itself hindered in the performance of a service by circumstances of any kind, it will inform the customer of this in writing in a timely manner. If Altmuehltal Relocation is not responsible for the impending circumstances, the contracting parties shall agree on an appropriate postponement of the agreed dates. If the timely written notification is omitted, the service provider may not later invoke these circumstances.
Should no agreement be reached between Altmuehltal Relocation and the customer, the customer is entitled to withdraw from the contract and any payments already made will be refunded.
(2) In cases of force majeure, the contracting party affected thereby shall be released from the obligation to perform for the duration and to the extent of the effect.
Force majeure is any event beyond the control of the respective contracting party that prevents it in whole or in part from fulfilling its obligations, including fire damage, pandemics, floods, strikes and lawful lockouts as well as operational disruptions or official decrees for which it is not responsible.
The affected party shall immediately notify the other party of the occurrence as well as the cessation of the force majeure and shall use its best efforts to remedy the force majeure and to limit its effects as far as possible.
In the event of force majeure, the contracting parties shall agree on the further procedure and determine whether, after its termination, the services not performed during this period shall be subsequently delivered. Notwithstanding the above, each Contracting Party shall be entitled to withdraw from the orders affected thereby if the Force Majeure lasts for more than four weeks from the agreed date of performance. The right of each contracting party to terminate the contract for good cause in the event of force majeure lasting for a longer period shall remain unaffected.
§ 5 Prices, terms of payment, price adjustment, offsetting prohibition(1) The current prices stated in advertisements and/or on our website shall apply. All prices are in euros and exclude VAT. These are total prices.
(2) We offer the following payment methods:
We reserve the right to exclude certain payment methods. All claims are due directly after the performance of the service and upon receipt of the invoice within 14 days and are payable without deduction.
(3) In the event that the customer fails to make payment when due, the outstanding amounts shall bear interest from the due date at 5% points above the base interest rate; if the customer is an entrepreneur, the outstanding amounts shall bear interest from the due date at 9% points above the base interest rate. The assertion of higher interest and further damages in the event of default remains unaffected.
(4) Offsetting against counterclaims of the customer or the retention of payments due to such claims shall only be permissible insofar as the counterclaims are undisputed or have become res judicata or arise from the same order under which the service in question was performed.
§ 6 Right of withdrawalIn the case of contracts concluded outside business premises and in the case of distance contracts, you as a consumer are entitled to a right of withdrawal.
Right of withdrawalYou have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of conclusion of the contract.

by means of a clear declaration (e.g. a letter sent by mail or e-mail) about your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the withdrawalIf you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with respect to this contract compared to the total scope of the services provided for in the contract.
Additional notesThe right of withdrawal shall also expire in the case of a contract for the provision of services if the Entrepreneur has provided the service in full and has only started to perform the service after the Consumer has
- expressly agreed that the entrepreneur begins with the execution of the contract before the expiry of the withdrawal period and
- has confirmed his knowledge that by giving his consent he loses his right of withdrawal upon commencement of the performance of the contract.

§ 7 ConfidentialityAltmuehltal Relocation undertakes to keep secret all information and documents to which it has access in connection with the conclusion of the contract and which are designated as confidential or which are clearly recognizable as business or trade secrets of the customer according to other circumstances, and to neither record nor pass on or utilize them - unless required to achieve the purpose of the contract.
§ 8 Limitation of liability(1) Altmuehltal Relocation shall only be liable for damages caused intentionally or by gross negligence or in the event of culpable breach of a material contractual main obligation or cardinal obligation or in the event of non-fulfillment of a guarantee or if a defect was fraudulently concealed by Altmuehltal Relocation. A "cardinal obligation" within the meaning of this provision is an obligation of Altmuehltal Relocation, the fulfillment of which makes the proper performance of the contractual relationship between the parties possible in the first place, the breach of which jeopardizes the achievement of the purpose of the contract and on the compliance with which the customer regularly relies.
(2) In the event of a breach of a material contractual main obligation or cardinal obligation due to simple negligence, Altmuehltal Relocation's liability shall be limited to the typically foreseeable damage.
(3) Any further liability of Altmuehltal Relocation is excluded. The above exclusions of liability do not apply in the event of culpable injury to life, limb or health. Liability under the German Product Liability Act remains unaffected by these General Terms and Conditions.
(4) Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. In this respect, Altmuehltal Relocation is not liable for the constant and uninterrupted availability of our online presence.
§ 9 Data privacy (1) One of Altmuehltal Relocation's quality standards is to handle the personal data of its customers (this data is hereinafter referred to as "personal data") responsibly. Altmuehltal Relocation therefore only collects, stores and processes personal data resulting from the contractual relationship to the extent that this is necessary for the provision of services in accordance with the contract and is permitted by legal regulations or ordered by the legislator. Altmuehltal Relocation will treat the customer's personal data confidentially and in accordance with the provisions of the applicable data protection law and will not disclose it to third parties.
(2) In addition, Altmuehltal Relocation uses personal data of customers only if the customer has expressly consented to this. Any consent given by the customer may be revoked at any time.
(3) The customer is aware that for the implementation of pre-contractual measures and fulfillment of the contractual relationship, the collection, processing and use on the basis of Art. 6 paragraph 1 lit. b) DSGVO, among other things, of his name, consumer or entrepreneur status, address, date of birth and bank details are required.
(4) Altmuehltal Relocation will comply with the relevant statutory provisions, in particular the General Data Protection Regulation (DSGVO), with regard to personal data of the customer.
(5) For the rest, Altmuehltal Relocation refers to their privacy policy (link to
privacy policy).
§ 10 Closing provisions(1) The contract existing between us and the customer shall be governed by the law of the Federal Republic of Germany, subject to mandatory international private law provisions, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If, however, the customer is a consumer and has his habitual residence in another country, he shall retain protection under the relevant provisions of the country of residence, which may not be deviated from by agreement.
(2) If the customer is a merchant within the meaning of Section 1 (1) of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the courts in Beilngries shall have exclusive jurisdiction for all disputes arising from or in connection with the contractual relationship in question. In all other cases, we or the customer may bring an action before any court having jurisdiction based on statutory provisions.
(3) Altmuehltal Relocation draws the customer's attention to the fact that as a consumer, in addition to the ordinary legal process, the customer also has the option of an out-of-court settlement of disputes in accordance with Regulation (EU) No. 524/2013. Altmuehltal Relocation points out in accordance with § 36 VSBG that Altmuehltal Relocation is not obliged to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
(4) Should any provision of these General Terms and Conditions be or become invalid, this shall not affect the legal validity of the remaining provisions. In place of the invalid provision, a valid provision shall be deemed to have been agreed which comes as close as possible to the economic purpose intended by the parties.
